Terms and Conditions for Leaders Partner Program

Effective Date: Upon agreement and acceptance into the Facilitator Partner Program.

1. Agreement to Terms:

By joining the Book Wellness Retreats Leader Partner Program, you agree to be bound by these terms and conditions.

2. Eligibility:

To participate in the Facilitator Partner Program, facilitators must: • Be a registered business or individual capable of legally hosting retreats. • Offer high-quality retreat experiences that align with Book Wellness Retreats’ values and standards. • Comply with all applicable laws and regulations in the regions where retreats are held.

3. Application Process:

All facilitators must provide accurate and truthful information about their retreat offerings.

4. Approval Process:

Book Wellness Retreats will review each retreat's content and available information to ensure it meets the required standards for quality and alignment with our values. Book Wellness Retreats reserves the right to reject any application that does not meet these criteria. If a rejection is warranted, any funds paid by the client for services will be promptly refunded in full.

5. Content Creation:

Upon approval, leaders grant Book Wellness Retreats the right to create marketing content (including but not limited to posts, reels, stories, banners, and email campaigns) to promote their retreats on our platform and affiliated channels. Any content created by Book Wellness Retreats, including a sales page, is the creative interpretation of the material and details provided by the leader. Book Wellness Retreats makes the content in its own vision and is not subject to revisions by the leader, aside from typos or other errors in the details of the retreat. A leader can request one (1) round of minor edits, not exceeding 5 items, to a newly created sales page. Additional edits can be done at the hourly rate of $45usd.

6. Retreat Listings:

Leaders are responsible for providing accurate and up-to-date information about their retreats, including descriptions, dates, pricing, and inclusions.

7. Commission Fees:

Book Wellness Retreats does not charge a commission fee. There is, however, a 4.5% processing fee for all deposits made.

8. Deposit Collection:

When a successful booking is made through Book Wellness Retreats, a deposit will be collected from the participant. This deposit will be held by Book Wellness Retreats for 30 days and then transferred to the leader, minus the 4.5% processing fee. No further payments to Book Wellness Retreats will be required from the leader or the participant.

9. Refund Policy:

For Clients: Book Wellness Retreats offers a 'No questions asked, 30-Day money-back guarantee' for clients booking a retreat that begins more than 90 days from the booking date. For retreats starting in less than 90 days, there is a 72-hour free cancellation period. After these periods, the deposit is non-refundable. If a client cancels within the allowed timeframe, Book Wellness Retreats will refund their deposit, and no commission will be charged.

For Leaders: If a guest cancels a booking where the deposit is non-refundable, Book Wellness Retreats will refund 50% of the deposit to the retreat leader, minus processing fees. For bookings made through affiliates, where 75% of the deposit has been paid to the affiliate, 12.5% of the deposit (minus fees) will be refunded to the retreat leader.

10. Marketing Support:

Book Wellness Retreats will promote leaders' retreats through its marketing channels, including but not limited to its website, social media, email newsletters, and affiliate network.

11. Affiliate Marketing Terms (If Applicable):

Affiliates are compensated with 75% of the deposit collected for each successful booking. Affiliate tracking is done using cookies and unique affiliate links to ensure accurate tracking. Payouts to affiliates are made 30 days after the deposit is collected.

12. Liability and Indemnity:

Book Wellness Retreats is not responsible for the facilitation or quality of the retreats listed. The leader agrees to indemnify and hold Book Wellness Retreats harmless from any claims arising from the retreat itself.

13. Force Majeure:

Neither party shall be liable for failure to fulfill obligations due to events beyond their control, including but not limited to natural disasters, acts of government, pandemics, or other unforeseen events.

14. Data Protection and Privacy:

Book Wellness Retreats adheres to all applicable data protection laws. Personal data shared for retreat bookings or marketing will be handled according to our Privacy Policy.

15. Intellectual Property:

All marketing content created by Book Wellness Retreats remains the intellectual property of Book Wellness Retreats and may be used in future promotional materials, unless white-labeled social media content is specifically requested by the client as part of the Master Packages.

16. Disclaimers:

Book Wellness Retreats does not guarantee any specific number of bookings or financial outcomes as a result of listing a retreat on our platform. Success depends on several factors, including market demand, facilitator input, and external conditions.

17. Termination:

Book Wellness Retreats reserves the right to terminate its partnership with any leader who violates these terms and conditions or engages in conduct deemed harmful to our brand or reputation.

18. Modification of Terms:

Book Wellness Retreats reserves the right to modify these terms and conditions at any time. Leaders will be notified of any changes and are responsible for adhering to the updated terms.

19. Governing Law:

These terms and conditions are governed by and construed in accordance with the laws of the United States of America. Any disputes arising from these terms shall be subject to the jurisdiction of the courts of the United States of America.

By joining the Leader Partner Program via the purchase of a package, you acknowledge that you have read, understood, and agreed to these terms and conditions.
